The Risk of Driving Before Reinstatement Is Complete

Many drivers don’t realize that getting back behind the wheel before reinstatement is formally complete carries serious legal consequences. In New York, driving on a suspended or revoked license is charged as Aggravated Unlicensed Operation (AUO) under Vehicle and Traffic Law Section 511. Third-degree AUO is a misdemeanor. It escalates to second-degree if the driver had a prior AUO conviction within the preceding 18 months, if the suspension or revocation was related to a DWI charge or chemical test refusal, or if the driver had three or more suspensions imposed on at least three separate dates. It rises to a first-degree felony if the driver committed a second-degree AUO while also operating under the influence of alcohol or drugs, or if the driver had ten or more suspensions imposed on at least ten separate dates.

An AUO conviction can mean fines, jail time, an extended suspension period, and a criminal record that follows you into employment and housing applications. Unresolved suspensions don’t quietly disappear from your DMV abstract, either. Even after restoration, the record of that suspension stays on your driving history for at least four years. Acting on reinstatement promptly and correctly can help protect you from compounding a traffic matter into something far more serious.

Understanding Your Suspension or Revocation

The reinstatement process in New York depends on which type of license action you’re dealing with. The three categories each follow a different path:

Definite Suspension
This type carries a fixed end date. A common example is a suspension triggered by accumulating too many points within a set period under New York’s point system. Once the suspension period ends and the required fees are paid, your license is restored.

Indefinite Suspension
This type stays active until you resolve the underlying problem. Unpaid fines, failure to answer a traffic ticket, a lapse in insurance, or unresolved court obligations can all trigger an indefinite suspension. It doesn’t end on its own.

License Revocation
A revocation cancels your license entirely. DWI or DWAI convictions, chemical test refusals, serious vehicular crimes, and repeat serious traffic violations can all lead to revocation. To drive again, you must apply for a new license after the revocation period is served. Out-of-state and Canadian license holders can have their New York driving privilege revoked independently of their home-state license, creating a separate reinstatement obligation here.

The New York Reinstatement Process

For a suspended license, reinstatement means serving the full suspension period, paying the suspension termination fee, completing any court-mandated programs, and submitting proof of compliance. For a revoked license, the process is more involved.

Restoring a Revoked License Through the DMV DIU

After serving the revocation period, you must request approval from the NY DMV Driver Improvement Unit (DIU). Online requests may receive immediate approval if you meet eligibility requirements. Mail requests can take up to 12 weeks to process and can’t be submitted more than 30 days before the revocation period ends. The reapplication fee is $100. Once the DIU approves the application, you’ll need to obtain a new license at a motor vehicle office and may be required to pass written and road tests again.

Alcohol-Related Revocations & Repeat Offenses

Any new moving violation added to your record during the revocation period can delay or deny approval. For alcohol-related revocations, completion of the Impaired Driver Program (IDP) is often required before relicensing. Drivers with two or more alcohol- or drug-related convictions within 25 years must complete an alcohol evaluation or treatment program. Three or more alcohol- or drug-related driving convictions within a 25-year period can result in an extended denial of relicensing or, when combined with a serious driving offense in that same period, a permanent lifetime denial.
